Terms of Responsibilities
Responsible subjects: Supplier, Carrier, Recipient
Notice: By placing an order with Femtoz you acknowledge and accept these regulations in their entirety.
The responsibilities for pharmaceuticals sold abroad can be broken down as follows:
A - Supplier/Exporter: Femtoz
Responsible, with the aid of the GDP (good distribution practices) quality system, for making sure that:
1. The packing, transport and delivery of the medication will have no effect on the quality or effectiveness of the product in any way.
2. The medication is delivered in its original packaging (with the explanatory leaflet inside) and that it is accompanied by a specific method of use.
3. Recommendations have been provided by a health professional (with supervision by a pharmacist).
With the delivery of the package to the Carrier/Transporter designated by the Recipient/Importer, the duties and responsibilities of the Supplier/Exporter are terminated.
B - Carrier/Transporter: FedEx, DHL, UPS, United States Postal Service, Canada Post, others.
Responsible for observing the following rules:
1. To pick up the packages at the agreed-upon time.
2. To respect the particular transport conditions requested, such as temperature.
3. To respect the agreed-upon delivery times.
4. To contact the recipient the day the merchandise arrives in the destination country, providing him the reference number of his package (AWB) and asking for any missing documentation that may be necessary for the importation of the medication in question. For the USA: Import authorization by FDA, etc.
5. To ensure the observance of all current legal requirements in the destination country. The carrier assumes total and exclusive responsibility for any omissions or violations of the latter.
6. To pay VAT, and any other taxes and import duties, in addition to the transport and to then bill the recipient for them. The carrier assumes total and exclusive responsibility for any omissions or violations of tax or customs regulations.
7. To make sure that the medication shipped is delivered only to the recipient or to a third party in possession of a written proxy, signed by the recipient.
8. Once the products are delivered to the Carrier/Transporter, they become the property of the Recipient/Importer. For this reason, all risks relative to the merchandise pass to the latter.
C - Recipient/Importer
Responsible for observing the following rules:
1. Selecting and hiring a trusted carrier/transporter (such as FedEx, DHL, UPS, United States Postal Service, Canada Post, others) for the pick-up, importation and delivery of the medications acquired to his address.
2. To obtain permission from the Ministry of Health or other competent authority for the importation of the product into his country, in a timely manner. Respectively, an authorization to import with a prescription and, possibly, the assumption of medical responsibility by his attending physician.
3. To ensure observance of all current law in his country. The recipient/importer assumes the total and exclusive responsibility for any omissions or violations of the latter.
4. To pay VAT and any taxes and import duties, in addition to the transport. The recipient/importer assumes total and exclusive responsibility for any omissions or violations of tax or customs law.
5. To inform the patient that he must respect the dosage of the medical prescription and scrupulously follow the advice provided by the health professional.
6. Check that the medications are not being used by other persons.
7. Warn the patient that he must immediately contact his own attending physician if problems should arise in relation to the medication provided.
